An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.
Why this matters: For Chennai agencies, printers and works contractors, the goods and service components of a composite contract should be clearly valued in the agreement and the invoice so that only one tax attaches to each element of value.

Every central tax rate notification for goods has an integrated tax twin carrying exactly double the central rate, because IGST on an interstate supply equals CGST plus SGST. A schedule entry at 9 per cent central tax therefore appears at 18 per cent in the integrated tax notification. State GST notifications issued by the Tamil Nadu Commercial Taxes Department replicate the central schedules word for word, so the rate on a product is identical whether the sale is within Chennai or to another State.
What it means for you: Do not look for a different rate on interstate sales; only the head of tax changes, so a Chennai seller charges IGST at the same combined percentage on a supply to Bengaluru.

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.
