Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.
Why this matters: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.
Juspay Technologies Pvt Ltd (Namma Yatri) — AAR Karnataka, Advance Ruling No. KAR ADRG 31/2023, dated 15 September 2023 · 2023-09-15
The Karnataka AAR held that Juspay's Namma Yatri app, which merely connects auto-rickshaw drivers with passengers on a software-as-a-service model and does not control ride fulfilment or collect the fare, is an e-commerce operator but is not the person liable under Section 9(5) to pay GST on passenger transport supplied through it. The ruling turned on the platform's limited role. The authority subsequently issued a notice proposing to declare the ruling void, and the Karnataka High Court stayed that notice, so the position remains under litigation.
Practical effect: Marketplace and app businesses should map who controls supply and collection before assuming Section 9(5) liability, and watch this litigation closely.
Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.
Practical effect: Chennai employers and contractors should resist departmental demands on notice pay recovery and liquidated damages by citing this circular in the reply itself.
