The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Which platform collects TCS when two e-commerce operators are in one transaction

In the Open Network for Digital Commerce and similar multi-platform models, a buyer-side application and a seller-side application both participate in a single order. CBIC clarified that where the supplier-side operator is not itself the supplier, that supplier-side operator collects tax at source and complies under Section 52. Where the supplier-side operator is itself the supplier of the goods or services, the buyer-side operator collects instead. Only one operator collects TCS in any transaction, avoiding duplication.

The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. Rainbow Papers was confined to its own facts, where a resolution plan had been approved ignoring statutory dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.

What is GSTR-8 and does a seller have to file it?
GSTR-8 is filed by the e-commerce operator, not the seller. Operators like Amazon, Flipkart and Meesho file it by the 10th of the following month, reporting supplies made through their platform and the TCS collected against each seller's GSTIN. As a seller, your job begins after that: the TCS appears in your TDS and TCS credit received statement, which you accept to move the amount into your electronic cash ledger. You also cross-check the operator's reported figures against your own sales report, because mismatches between GSTR-8 data and your GSTR-1 can trigger notices.
Can I use my home in T. Nagar as the business address for e-commerce GST registration?
Yes. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in T. Which daily-use grocery items became cheaper under GST from September 2025?

Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid.
