The advance ruling authorities denied exemption on the view that the lessee was using the property commercially. The High Court disagreed and held that leasing residential premises used as a hostel falls within Entry 13 of the IGST services exemption notification, since that entry does not require the lessee itself to occupy the premises as a residence. The Supreme Court dismissed the State's appeals on 4 December 2025 and confirmed that the end use as a residence, not the intermediate commercial layer, decides the question.

This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.

Part A can be prepared in advance while awaiting vehicle placement, but the e-way bill becomes valid for movement only once Part B is filled, and validity is counted from that point. For distances up to fifty kilometres to a transporter within the state, Part B is relaxed.
What is confiscation under Section 130 and how is it different from detention?
Detention under Section 129 is temporary custody pending a penalty for a transit contravention. Confiscation under Section 130 is the graver step where the department alleges intent to evade tax, for instance supplying unaccounted goods, or using a conveyance for carrying goods in contravention with the owner's knowledge. Confiscated goods vest in the government, but the owner is given an option to pay a fine in lieu of confiscation up to the market value of the goods less the tax, in addition to tax and penalty. The conveyance owner can similarly redeem the vehicle by paying a fine equal to the tax payable on the goods carried.
My vehicle was stopped and detained by a GST squad. What is the process that follows?
Interception follows a defined MOV trail. The officer records a statement in MOV-01, orders physical verification in MOV-02, and completes an inspection report in MOV-04 within the prescribed time. If discrepancies are found, a detention order in MOV-06 issues along with a notice in MOV-07 stating the proposed penalty, which the law requires within seven days of detention.
