Where a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code and the government's claim is scaled down, the tax department cannot continue to pursue the original demand. The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.
What it means for you: If a Chennai company has come out of insolvency, insist on a DRC-25 intimation so that the old demand stops appearing in the recovery register and blocking registration or refunds.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.
What to do about it: Chennai group companies giving guarantees to each other should review the current GST valuation rule, since the earlier no-consideration argument no longer holds under GST.

After the 1 February 2018 launch was withdrawn when the portal could not handle the load, the Council recommended introducing the e-way bill for inter-State movement of goods across the country from 1 April 2018, with intra-State movement to follow in a phased manner on dates to be announced but not later than 1 June 2018. It simultaneously approved a substantially revised set of rules addressing the complaints raised during the failed first attempt.
Practical effect: 1 April 2018 is the operative national start date for inter-State e-way bills, and the correct reference point for any Chennai consignment questioned for an earlier period.
