A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What is the time limit for filing a GST appeal against an order?
An appeal to the appellate authority must be filed in Form APL-01 within three months from the date the order is communicated to you. The appellate authority can condone a delay of up to one further month if you show sufficient cause, but has no power to admit an appeal beyond that. The clock runs from communication of the order, which is usually the date it is served on the portal. Diarise the deadline the day you receive any adverse order, because gathering documents, computing the pre-deposit and drafting grounds takes time. How much pre-deposit do I have to pay for a GST appeal?
To file an appeal you must pay the admitted tax, interest and penalty in full, plus a pre-deposit of 10 percent of the disputed tax amount. Only the tax in dispute counts for the 10 percent; disputed interest and penalty do not require any pre-deposit, except that an appeal against an e-way bill detention penalty order under Section 129(3) requires payment of 25 percent of the penalty. Once the appeal is filed with this payment, recovery proceedings for the balance amount are deemed stayed until the appeal is decided. The pre-deposit can be paid from the electronic cash ledger, and courts have also accepted credit ledger payment for the tax component. What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Scrutiny can be closed with a good reconciliation; an audit needs sustained document management and negotiation over weeks. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases.
