CBIC directed that disputed credit, meaning CENVAT credit which the last adjudication order or the last order-in-appeal as it stood on 1 July 2017 had held to be inadmissible, must not be utilised to discharge liability under the CGST or IGST Act for as long as that order remains in existence, and that if it is used it will be recovered with interest and penalty. The same direction was given for blocked credit, that is credit carried forward under section 140(1) even though it is ineligible under section 17(5), the examples given being telecommunication towers and pipelines laid outside the factory premises.
Why this matters: Businesses that carried forward disputed excise or service tax credit into GST should keep the underlying orders and appeal papers ready, and should not set that credit off against output tax while an adverse order stands.

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.

The Supreme Court held that where a State tax statute creates a first charge on the assets of a defaulting dealer, the tax department qualifies as a secured creditor under the Insolvency and Bankruptcy Code. A resolution plan that simply ignores statutory tax dues, or provides nil recovery to the State, can be rejected. The decision considerably strengthened the position of tax authorities in corporate insolvency resolution processes.
What it means for you: A Chennai company entering insolvency cannot assume its GST and VAT arrears will be wiped out; statutory dues must be properly dealt with in the resolution plan.
