The Tamil Nadu AAR held that the electricity generated is an exempt supply, so credit on the solar plant is barred under Section 17(2) of the CGST Act read with Rule 43(a) of the CGST Rules, being attributable to exempt supplies. The Appellate Authority subsequently upheld the denial of credit on appeal.
Why this matters: Before investing in rooftop solar, model the GST cost assuming ITC may be denied where the power generated is consumed against exempt income streams.
55th GST Council Meeting, Jaisalmer — 21 December 2024 · 2024-12-21
The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.
