The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

GSTN Advisories dated 12 April 2023 and 6 May 2023 — time limit for reporting invoices on the Invoice Registration Portal · 2023-04-12

GSTN announced that taxpayers with aggregate annual turnover of one hundred crore rupees or more would be unable to report an invoice on the Invoice Registration Portal more than seven days after the document date, with effect from 1 May 2023. After representations the implementation was deferred by three months. The idea returned later as a thirty day reporting limit applying to taxpayers with turnover of ten crore rupees and above.

Practical effect: Large Chennai taxpayers should generate the invoice reference number on the day of billing rather than leaving e-invoicing to month end.

Inter-State sales to unregistered buyers must be reported in Table 3.2 of GSTR-3B

Circular No. 89/08/2019-GST dated 18 February 2019 · 2019-02-18

CBIC noticed that many taxpayers were not reporting details of inter-State supplies made to unregistered persons, composition dealers and UIN holders in Table 3.2 of FORM GSTR-3B, and in Table 7B of FORM GSTR-1 for invoices up to Rs 2.5 lakh. How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
How is interest calculated if I pay GST late?
Interest is charged at 18 percent per annum under Section 50 of the CGST Act, calculated day-wise from the due date until the date of payment. Following the amendment to Section 50, interest on delayed GSTR-3B filing applies only on the portion of tax paid through the electronic cash ledger, not on the amount settled using input tax credit. For example, a cash liability of Rs.1,00,000 paid 30 days late attracts roughly Rs.1,479 as interest. We compute this precisely before filing so clients in Koyambedu never overpay or underpay.
Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot. How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Each month, one-sixtieth of the credit on all common capital goods is attributed to the period, and the exempt proportion, computed on the exempt-to-total turnover ratio, is reversed in GSTR-3B with applicable interest treatment. Capital goods used exclusively for taxable supplies need no reversal, while those used exclusively for exempt supplies get no credit at all. Keep a capital goods register with commissioning dates, because the sixty-month clock and any change in use must be tracked asset-wise.
Which food items became completely tax-free under GST 2.0?
From 22 September 2025, UHT milk, pre-packaged and labelled paneer and chena, and all Indian breads including roti, chapati, paratha and khakhra attract nil GST. In the pharma space, thirty-three notified lifesaving drugs and medicines for cancer and rare diseases also moved to nil rate. Remember that selling nil-rated goods still has compliance effects: you issue a bill of supply instead of a tax invoice for such items, and input tax credit attributable to nil-rated supplies must be reversed proportionately under Rules 42 and 43. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.

Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands.
