The Supreme Court held that where a developer enters into an agreement with a buyer before construction is completed, the construction carried out thereafter is executed for the buyer and constitutes a works contract liable to tax. Tax can be levied only on the value of goods incorporated after the agreement date, and the value of land must be excluded. Section 30 as amended from 1 January 2021 allows the thirty-day period for applying for revocation of cancellation to be extended. Until a functionality was built on the portal, CBIC directed that the taxpayer file FORM GST REG-21 within the original period and separately apply by email or letter to the Joint or Additional Commissioner, who may grant a further thirty days, and thereafter to the Commissioner, who may grant another thirty days, with reasons recorded in each case.
