36th GST Council Meeting (video conferencing) — 27 July 2019 · 2019-07-27
The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.
Why this matters: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.

The Central Goods and Services Tax (Sixth Amendment) Rules, 2021 substituted Rule 80 to give effect to the abolition of the statutory audit. From the financial year 2020-21, a registered person whose aggregate turnover exceeds Rs 5 crore must furnish a self-certified reconciliation statement in Form GSTR-9C along with the annual return by 31 December of the following year. Form GSTR-9C was amended to remove the auditor's certification and recommendation portions and to convert them into a taxpayer verification.
Why this matters: The Rs 5 crore GSTR-9C threshold and the 31 December due date set by this rule are still the governing requirements for a Chennai business today.
Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.
What to do about it: Chennai employers and contractors should resist departmental demands on notice pay recovery and liquidated damages by citing this circular in the reply itself.
