Notification No. 19/2025-Central Tax (Rate), dated 31 December 2025 · 2025-12-31

Tobacco products had been left at twenty-eight per cent in Schedule VII when GST 2.0 took effect, pending discharge of the compensation cess loan obligations. This notification omits Schedule VII entirely with effect from 1 February 2026 and moves pan masala, unmanufactured tobacco and refuse, cigars and cigarettes, other manufactured tobacco and nicotine inhalation products into Schedule III at forty per cent. Biris of tariff items 2403 19 21 and 2403 19 29 were placed in Schedule II at eighteen per cent.

Practical effect: Tobacco and pan masala wholesalers in Chennai charge forty per cent on supplies made on or after 1 February 2026, with biris at the lower eighteen per cent rate.

CBIC laid down the prerequisites for an intermediary. There must be a minimum of three parties, and two distinct supplies, the main supply between two principals and the ancillary supply of arranging or facilitating it. GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.

Practical effect: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.

That excluded credit is not lost; it remains in your electronic credit ledger for set-off against future output tax. My GST refund was rejected by the officer. Do I have any remedy?
Yes. Before rejection, the officer must issue a notice in RFD-08 and consider your reply in RFD-09, so a rejection without hearing you is itself challengeable. Against a rejection order in RFD-06, you can file an appeal in Form APL-01 before the appellate authority within three months of the order. The ITC debited for the rejected claim is re-credited through PMT-03 where applicable. It depends on what you export. For export of goods, Rule 96B of the CGST Rules links refunds to realisation: if sale proceeds are not realised within the period allowed under FEMA, generally nine months, you must deposit the refund already received, proportionate to the unrealised amount, along with interest, within thirty days of the expiry of that period, and you can reclaim it by producing evidence of realisation within three months of receiving the money. For export of services, the consequence is even more direct: receipt of payment in convertible foreign exchange is itself a condition of export under Section 2(6) of the IGST Act, and refund claims must be backed by FIRC or BRC, so an unpaid service invoice never qualifies as a zero-rated export at all.
