For the tax periods July 2017 to January 2020 the late fee on GSTR-3B was capped at Rs 500 per return, being Rs 250 each under the central and State laws, and was waived completely where the return was a nil return. The concession applied only if the pending return was furnished between 1 July 2020 and 30 September 2020. The same notification also continued conditional waivers for the February to July 2020 returns.
What to do about it: This was the first true GST amnesty and it let Chennai businesses clear more than two years of backlog for a nominal fee, setting the template for the later 2021 scheme.

The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.

The Supreme Court struck down Rule 5(1) of the Service Tax (Determination of Value) Rules as going beyond the charging provision. It held that only the consideration for the taxable service can be brought to tax, and reimbursable expenses incurred by a service provider on behalf of the client cannot be added. The judgment established that valuation rules cannot expand the scope of the charging section.
