Following the Gujarat High Court's Amit Cotton Industries ruling, the Madras High Court held that claiming drawback does not disentitle the exporter to refund of IGST paid on exports, and directed the customs authorities to process the refund along with applicable interest, since the circular relied upon by the department could not override the statutory refund right.

The Central Goods and Services Tax (Fourth Amendment) Rules, 2021 made several refund changes. Rule 90 was amended so that the period from the filing of a refund application in Form GST RFD-01 to the communication of the deficiency memo in Form GST RFD-03 is excluded when computing the two-year limitation for the fresh application filed after rectifying the deficiencies. A new facility to withdraw a refund application in Form GST RFD-01W before an order is passed was introduced, with the debited amount credited back to the ledger.
