Deciding a service tax dispute whose reasoning applies equally under GST, the Supreme Court held that when an overseas group company seconds its employees to an Indian entity, and the Indian entity reimburses their salaries to the foreign company, the arrangement is a taxable supply of manpower services by the foreign company. Applying a substance-over-form test on the totality of the secondment agreements, the Court ruled the Indian company must pay tax under reverse charge on such arrangements.

CBIC Instruction No. 01/2025-GST · 2025-01-13
Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
What it means for you: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.
Notification No. 30/2020-Central Tax · 2020-04-03
The Central Goods and Services Tax (Fourth Amendment) Rules, 2020 inserted a proviso to Rule 36(4) so that the ten per cent restriction on credit for invoices not uploaded by suppliers would not be tested month by month for February to August 2020. Instead the condition applied cumulatively, and the cumulative adjustment had to be made in the GSTR-3B for September 2020. The amendment also allowed businesses to opt into the composition scheme for 2020-21 by a later date.
What it means for you: For the first COVID wave a Chennai taxpayer could take provisional credit freely and true it up only in the September 2020 return, which is a defence to scrutiny of those months.
