Notification No. 52/2020-Central Tax · 2020-06-24

For the tax periods July 2017 to January 2020 the late fee on GSTR-3B was capped at Rs 500 per return, being Rs 250 each under the central and State laws, and was waived completely where the return was a nil return. The concession applied only if the pending return was furnished between 1 July 2020 and 30 September 2020. The same notification also continued conditional waivers for the February to July 2020 returns.

Why this matters: This was the first true GST amnesty and it let Chennai businesses clear more than two years of backlog for a nominal fee, setting the template for the later 2021 scheme.

GST on fertilisers cut to five per cent on the eve of rollout

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

Practical effect: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.

Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Koyambedu demand case.
