Credit available on ex-works purchases when goods are handed to the transporter

Circular No. 241/35/2024-GST · 2024-12-31

In an ex-works contract, title and risk pass at the supplier's factory gate when goods are handed over to the carrier arranged by the buyer, even though physical delivery to the buyer happens later. CBIC clarified that the condition of receipt of goods in Section 16(2)(b) is satisfied at that point through the deemed-receipt provision, so the buyer may claim input tax credit in that period, subject to actual receipt, use in business and the other conditions of Section 16.

Practical effect: Buyers on ex-works terms, common in the automobile supply chain, need not defer credit to the month of physical arrival at their premises.

Maharashtra, Assam and Bihar had pressed for 1 April 2017, Assam adding that changing the tax regime in the middle of a financial year was undesirable, but the Chairperson observed that the legal and rate work would spill into March 2017 and that an April deadline had become a major challenge. Tamil Nadu and Karnataka supported 1 July 2017 as the more practical date.

Can my GST consultant attend a summons hearing on my behalf in Madipakkam?

You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Can a compliance review actually prevent GST notices?
Largely, yes. Most notices arise from mismatches the portal detects automatically: GSTR-1 versus GSTR-3B tax differences, ITC claimed beyond GSTR-2B, e-way bill turnover gaps and unfiled returns. A periodic review catches these before the system does, so you can correct them through amendments in subsequent returns or a voluntary DRC-03 payment with interest, which under Section 73 attracts no penalty and no notice for the amount paid. I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a).
