The applicant promoted the products of overseas manufacturers in India and also carried out installation, commissioning and after-sales support for Indian customers, billing the foreign principal in convertible foreign exchange. The Karnataka Authority for Advance Ruling held that this activity facilitates the supply between the foreign principal and the Indian customer, making the applicant an intermediary. The place of supply is therefore in India and the receipts do not qualify as export of service.
What to do about it: Chennai firms invoicing foreign principals for marketing or support work should test the intermediary risk before treating the receipts as zero-rated exports.

This notification made the Central Goods and Services Tax Rules, 2017. In its original form it carried the chapters on preliminary definitions, composition levy and registration, together with the associated forms in the REG and CMP series. The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution. Only a discriminatory tax that favours local goods over goods from other States is hit. The judicially created concept of compensatory tax was discarded as having no constitutional basis. State entry tax laws were largely upheld, subject to the test of discrimination.
