Notification No. 03/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13
Giving effect to the 47th GST Council's rate rationalisation, this notification raised the rate on works contract services supplied to the Central Government, State Government, Union territory and local authorities from 12 per cent to 18 per cent with input tax credit, applying from 18 July 2022. Several High Courts, including the Madras High Court, have since heard petitions by contractors seeking reimbursement of the differential tax from the awarding department on contracts priced before the change.
Why this matters: Chennai civil contractors with pre-July 2022 government tenders should pursue a differential-tax claim with the department rather than absorbing the 6 per cent increase.

The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.
Why this matters: An exempt category business such as a bank, insurer or goods transport agency in Chennai need not issue e-invoices for any of its supplies, not merely its core activity.

Resident welfare associations challenged the CBIC circular and AAR view that once monthly maintenance exceeds Rs 7,500 per member, GST applies on the entire amount. The Madras High Court held that the exemption operates up to Rs 7,500, and only the amount in excess of that threshold is taxable — the term 'up to' marks a clear slab. The circular's contrary interpretation was quashed as contrary to the exemption notification.
