Following the Supreme Court directions in Union of India versus Filco Trade Centre, the Board issued guidelines allowing every aggrieved taxpayer to file or revise FORM GST TRAN-1 and TRAN-2 on the common portal during a special window from 1 October 2022 to 30 November 2022. The circular set out the declaration to be filed, the requirement to submit a self-certified copy to the jurisdictional officer, and the verification timelines that follow the filing.
Practical effect: Transitional credit disputes from 2017 that reached the courts were routed through this one-time window, and any pending verification of a Chennai taxpayer's TRAN filing is governed by these guidelines.

The Supreme Court examined contracts for supplying cranes, tankers and vehicles to ONGC. It held that a transfer of the right to use goods requires the customer to obtain effective control and legal right to use the goods to the exclusion of the owner. Where the owner retains the operator, control and responsibility, the arrangement is a service contract and not a deemed sale. Sales tax or VAT was therefore not attracted; service tax was.

This notification amended Notification 08/2017-Central Tax (Rate) to extend the exemption from reverse charge on intra-State supplies received by a registered person from an unregistered supplier, moving the end date from 31 March 2018 to 30 June 2018.
