From 1 January 2021 the date of the debit note, and not the date of the underlying invoice, determines the financial year for the time limit in section 16(4), so credit on an old invoice can still be taken through a later debit note. Where an invoice carries an Invoice Reference Number under the e-invoicing system, the transporter need not carry a physical copy. The bar on refund of unutilised credit applies only to goods actually subjected to export duty.

The applicant promoted the products of overseas manufacturers in India and also carried out installation, commissioning and after-sales support for Indian customers, billing the foreign principal in convertible foreign exchange. The Karnataka Authority for Advance Ruling held that this activity facilitates the supply between the foreign principal and the Indian customer, making the applicant an intermediary. The place of supply is therefore in India and the receipts do not qualify as export of service.
What to do about it: Chennai firms invoicing foreign principals for marketing or support work should test the intermediary risk before treating the receipts as zero-rated exports.
In Re: Cognizance for Extension of Limitation — Supreme Court, Suo Motu Writ Petition (C) No. 3 of 2020, order dated 10-01-2022 · 2022-01-10
Exercising its powers under Article 142, the Supreme Court directed that the period from 15 March 2020 to 28 February 2022 shall stand excluded in computing limitation for any suit, appeal, application or proceeding, whether under general law or any special law. Where the balance limitation remaining was less than ninety days, a fresh period of ninety days from 1 March 2022 was granted. Statutory authorities were bound by this direction.
