Rule 96(10) had barred exporters who imported inputs without paying IGST, typically under Advance Authorisation or EPCG, from exporting on payment of IGST and claiming refund of that tax. Rules 89(4A) and 89(4B) prescribed a restrictive formula for their credit refunds. All three were omitted with prospective effect from 8 October 2024, removing a provision that had generated a large volume of recovery notices against exporters.
What it means for you: Exporters may follow the with-payment refund route for shipments made from 8 October 2024, though demands for earlier periods survive and still need to be defended.

The Council reduced GST on three cancer drugs — Trastuzumab Deruxtecan, Osimertinib and Durvalumab — from 12 per cent to 5 per cent. Extruded or expanded savoury snacks and namkeens were cut from 18 per cent to 12 per cent prospectively, aligning them with similar ready-to-eat namkeens, while un-fried snack pellets stayed at 5 per cent. The Council also brought roof-mounted package unit (RMPU) air conditioning machines for railways under 28 per cent and moved car seats from 18 per cent to 28 per cent.
What to do about it: Snack manufacturers and distributors in Chennai should apply 12 per cent prospectively from the notification date, keeping evidence of the cut-off for past-period disputes.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
