The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.

Council fixes the basic GST registration threshold at Rs 20 lakh

At its very first meeting the Council debated exemption thresholds ranging from Rs 10 lakh to Rs 25 lakh and finally agreed that a business would not need GST registration until its aggregate turnover crossed Rs 20 lakh. For the eleven Special Category States listed in Article 279A of the Constitution, the threshold was set at Rs 10 lakh. The Chairperson recorded that the figure would be reviewed after five years, once the compensation guarantee to States had run its course.

Why this matters: The Rs 20 lakh figure that still governs whether a small Chennai service business must register was settled at this meeting and has been the starting point for every later threshold change.

Bricks and roofing tiles kept at 12 per cent when GST 2.0 abolished that slab

Notification No. 14/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

Although the twelve per cent slab was otherwise removed, this standalone notification preserves it for the brick trade. From 22 September 2025 fly ash bricks, fly ash aggregates and fly ash blocks of heading 6815, bricks of fossil meals or similar siliceous earths of tariff item 6901 00 10, building bricks of tariff item 6904 10 00 and earthen or roofing tiles of tariff item 6905 10 00 attract six per cent central tax, that is twelve per cent combined.

What it means for you: A building material dealer in Chennai still bills bricks and roofing tiles at twelve per cent, not eighteen, and must not assume the GST 2.0 slab merger applied to them.

Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. If your business deals in any of these lines, pricing and working capital need careful planning.
My customer in Mumbai asked me to deliver goods directly to his buyer in Sithalapakkam. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. So you invoice the Mumbai customer with IGST even though the goods physically moved within Tamil Nadu, and the Mumbai customer raises a second invoice on the ultimate recipient in Sithalapakkam. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Sithalapakkam use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
Is GST payable under reverse charge on payments made to our company directors?

Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings.
