Why this matters: A Chennai cloud kitchen bills at 5 per cent without credit, but an ice cream parlour selling tubs and cones must charge the goods rate and can keep its credits.

This was the first notification issued under the CGST Act. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.
