A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.

Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises.
