Circular No. 225/19/2024-GST · 2024-07-11

Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Royapettah businesses, since no appeal is provided against DRC-22. The 5 percent slab now covers most household essentials that earlier fell in the 12 or 18 percent brackets: soaps, shampoos, toothpaste and toothbrushes, hair oil, bicycles, kitchen utensils and tableware. Packaged foods such as butter, ghee, cheese, namkeens, sauces, pasta, biscuits and chocolates are also at 5 percent, as are most medicines, medical devices and agricultural machinery. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
My shop's landlord in Royapettah is not GST registered. Do I pay GST on the rent myself?
