For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. CBIC clarified that transactions in vouchers are neither a supply of goods nor of services. Where a voucher is dealt with on a principal-to-principal basis, no GST arises on its sale or distribution. Where a distributor acts as an agent for a commission, GST applies on that commission. Additional services such as marketing, customisation and technology support are taxable at eighteen per cent, and unredeemed vouchers, or breakage, do not attract GST as no supply takes place.
What to do about it: Retailers and platforms issuing gift vouchers should charge GST only on the underlying goods at redemption and on any commission earned, not on the voucher sale itself.

The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
What to do about it: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
