For online services supplied to unregistered persons, including OIDAR services, online gaming and subscriptions, CBIC clarified that the supplier must record the recipient's State on the tax invoice, which is then deemed the address on record for determining place of supply under Section 12(2)(b). Failure to collect and record the State means incorrect place of supply, wrong apportionment of tax between States, and exposure to penal action under Section 122(3)(e).

The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.

How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot. Unlike the old VAT regime, GST allows the entire input tax credit on capital goods in the month of receipt, provided the machinery is used for taxable supplies and the invoice appears in your GSTR-2B. The one critical condition sits in Section 16(3): if you claim income tax depreciation on the GST component of the asset's cost, the credit is denied. So capitalise the machine at its value excluding GST, claim the GST as credit, and depreciate only the net cost. We regularly find fixed asset registers in T. Nagar where the accountant capitalised the gross amount, silently forfeiting the entire credit.
My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?
No, not until it appears. The two are treated very differently. Goods disposed of as gifts or free samples attract the block under Section 17(5)(h), so ITC on inputs used for genuinely free samples must be reversed. However, CBIC Circular 92/11/2019 clarifies that buy-one-get-one offers are not free supplies; they are effectively two goods sold for a single price, tax is charged on that price, and full ITC remains available. Trade discounts recorded in the invoice also do not disturb credit. Pharmaceutical distributors and FMCG dealers in T. Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?
After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
