M/s. Ajay Agency v. State Tax Officer — Madras High Court, W.P. No. 8507 of 2023, decided 30 March 2023 (Anita Sumanth J.) · 2023-03-30

A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.

What to do about it: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.

55th GST Council Meeting, Jaisalmer — 21 December 2024 · 2024-12-21

The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

Practical effect: Construction suppliers dealing in fly-ash-based AAC blocks should bill at 12 per cent and revisit classification disputes on past supplies.

Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.

What to do about it: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.

What is a debit note under GST and when do I issue one?

Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. Sales returns in T. How does a GTA opt for forward charge, and by when must it be done?

Can I issue a single credit note against several invoices?
Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. A distributor giving a season-end adjustment to a retailer can therefore issue one consolidated credit note covering dozens of invoices, rather than one note per bill. When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.
My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Each month, one-sixtieth of the credit on all common capital goods is attributed to the period, and the exempt proportion, computed on the exempt-to-total turnover ratio, is reversed in GSTR-3B with applicable interest treatment. Capital goods used exclusively for taxable supplies need no reversal, while those used exclusively for exempt supplies get no credit at all. Keep a capital goods register with commissioning dates, because the sixty-month clock and any change in use must be tracked asset-wise.
Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot. Unlike the old VAT regime, GST allows the entire input tax credit on capital goods in the month of receipt, provided the machinery is used for taxable supplies and the invoice appears in your GSTR-2B. The one critical condition sits in Section 16(3): if you claim income tax depreciation on the GST component of the asset's cost, the credit is denied. So capitalise the machine at its value excluding GST, claim the GST as credit, and depreciate only the net cost. We regularly find fixed asset registers in T. Nagar where the accountant capitalised the gross amount, silently forfeiting the entire credit.
I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. Most professional, business support and repair services billed by professional firms continue at 18 percent with full input tax credit.
Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
How do I decide whether to charge CGST plus SGST or IGST on an invoice?
Compare two data points: the location of the supplier and the place of supply determined under the IGST Act. If both fall in the same state, the supply is intra-state and you charge CGST plus SGST; if they fall in different states, it is inter-state and you charge IGST. The buyer's billing address alone is not the test; the place of supply rules for the specific goods or service govern. Common traps include hotel stays, property-linked services and bill-to ship-to chains, where the place of supply departs from the customer's address.
