The Council completed the fitment exercise for goods and broadly approved GST rates at nil, five, twelve, eighteen and twenty-eight per cent across the tariff, along with the rates of GST compensation cess to be levied on specified goods. The chapter-wise, rate-wise schedule dated 18 May 2017 was published on the CBEC website immediately after the meeting, subject to further vetting, and formed the basis of the rate notifications issued for the 1 July 2017 rollout.

Compensation cess: the extra levy that sat on top of 28 per cent goods

Notification No. 1/2017-Compensation Cess (Rate), dated 28 June 2017 · 2017-06-28

Under the GST (Compensation to States) Act, 2017 a separate cess was levied on a short list of demerit and luxury goods over and above GST. Coal carried a specific cess per tonne, aerated waters attracted twelve per cent, motor cars carried one to twenty-two per cent depending on engine capacity and length, and pan masala, cigarettes and chewing tobacco carried the heaviest rates. Cess credit could only be set off against cess, never against CGST, SGST or IGST.

Why this matters: Dealers who handled cars, coal or aerated drinks had to maintain a separate compensation cess ledger, and that ring-fenced credit remains a live issue in old assessments.

Circular

One-time chance to revive registrations cancelled up to March 2019

Circular No. 99/18/2019-GST dated 23 April 2019 · 2019-04-23

Following Removal of Difficulty Order No. 05/2019-Central Tax, CBIC clarified that a person whose registration was cancelled on or before 31 March 2019 for non-filing of returns could apply for revocation up to 22 July 2019. Where cancellation took effect from the order date, all returns up to that date had to be filed first. Where it was cancelled retrospectively, returns for the whole period from the effective date of cancellation had to be furnished within thirty days of the revocation order.

What to do about it: This was the first revocation amnesty and set the pattern of every later one, so a Chennai business with a dormant cancelled GSTIN should watch for such windows.

What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. There is no outer time limit on issuing a debit note itself. My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. How are B2B and B2C invoices reported differently in GST returns?

We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. Businesses in T. Nagar commonly pay agencies' forward-charge invoices while also missing their own RCM cases, so an annual review of security and manpower bills is worthwhile.
I heard old ITC demands for 2017-18 to 2020-21 were given relief. What is Section 16(5)?

Section 16(6) gives similar relief for returns filed after revocation of a cancelled registration. Where demands were already confirmed on this ground, a special rectification procedure was notified for taxpayers to have such orders corrected. If your T. My supplier issued a credit note against an earlier invoice. What must I do with the ITC?
When a supplier issues a credit note reducing the taxable value or tax, you must correspondingly reverse the proportionate ITC you had claimed on the original invoice, since the supplier's output liability reduces only when your credit reduces. The credit note flows into your GSTR-2B as a negative entry, and your GSTR-3B claim should net it off in the same period. With the Invoice Management System introduced on the portal from October 2024, you can accept, reject or keep pending supplier documents, and your action on a credit note directly shapes your GSTR-2B. Reconcile purchase returns, rate differences and discount credit notes monthly so reversals never lag behind.
Why is my nil return SMS to 14409 not working?
SMS filing fails for a few common reasons. The message must come from the exact mobile number registered against an authorised signatory on the GST portal, the format must match precisely with single spaces, and all returns for earlier periods must already be filed since GST returns are sequential. It also fails if the return is not truly nil, for instance if an amendment or credit note is pending to be reported. If one number is registered for multiple GSTINs, each needs its own SMS. We can diagnose the exact reason and file it online instead.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your T. Nagar godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
Which everyday goods now attract 5 percent GST?
The 5 percent slab now covers most household essentials that earlier fell in the 12 or 18 percent brackets: soaps, shampoos, toothpaste and toothbrushes, hair oil, bicycles, kitchen utensils and tableware. What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Missing fields make the invoice defective and can jeopardise your buyer's credit.
Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
Can you give me a simple GST due-date calendar for my business?
For monthly filers: GSTR-1 by the 11th and GSTR-3B by the 20th of the next month. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter. Composition dealers pay via CMP-08 by the 18th after each quarter and file GSTR-4 annually by 30 June. GSTR-7 and GSTR-8 are due on the 10th, and GSTR-9 and GSTR-9C by 31 December. Clients in T. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in T. I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
