The Madras High Court allowed the writ petition and directed that the return be permitted to be amended, describing the mistake as a bona fide human error. The Court observed that assessees should not be prejudiced from availing credit they are otherwise legitimately entitled to, particularly where the matching forms were never notified.

Reducing GST demands after an insolvency resolution plan is approved

Circular No. 187/19/2022-GST · 2022-12-27

Where a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code and the government's claim is scaled down, the tax department cannot continue to pursue the original demand. The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.

GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. How does a GTA opt for forward charge, and by when must it be done?

How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.

No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. I make both taxable and exempt supplies. How is the Rule 42 credit reversal actually computed?
Rule 42 first removes credit exclusively for exempt supplies and non-business use, and credit exclusively for taxable supplies, leaving the common credit. From this common pool, you reverse the portion equal to exempt turnover divided by total turnover for the month, plus a flat five percent of the common credit where inputs are partly used for non-business purposes. The reversal is declared monthly in GSTR-3B, and a final recomputation for the whole year must be done, with any shortfall paid with interest, by the November return following the financial year. Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more.
