Invoices had been raised showing the GSTIN of a group company instead of the actual recipient, which prevented the recipient from claiming credit. The High Court held the mistake was bona fide and inadvertent, applied Circular No. 183/15/2022-GST, and directed the authorities to permit rectification of the invoices and the corresponding returns for 2017-18 and 2018-19, and extended the same benefit to 2019-20 taking a justice-oriented approach.

Why this matters: A wrong GSTIN or similar clerical error in old invoices is not necessarily fatal — a rectification request supported by this judgment and Circular 183 is worth pursuing.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Circular No. 235/29/2024-GST, dated 11 October 2024 · 2024-10-11

Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.

The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?

How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. Both must match; mismatches between GSTR-1 and GSTR-3B are a common trigger for notices from the department, which is why we reconcile them before every filing.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My SaaS startup in T. Nagar bills both US and Indian customers. Is everything zero-rated?
No. Only the supplies satisfying the export conditions are zero-rated under your LUT. I heard old ITC demands for 2017-18 to 2020-21 were given relief. What is Section 16(5)?
The Finance (No. 2) Act 2024 inserted Section 16(5) retrospectively, allowing ITC for financial years 2017-18 to 2020-21 if it was claimed in a GSTR-3B filed on or before 30 November 2021, even though it breached the original Section 16(4) deadline. Section 16(6) gives similar relief for returns filed after revocation of a cancelled registration. Yes. Every registered taxpayer must file returns for every tax period, even when there are no sales, no purchases and no tax liability. In that case you file nil GSTR-1 and nil GSTR-3B. This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. So you invoice the Mumbai customer with IGST even though the goods physically moved within Tamil Nadu, and the Mumbai customer raises a second invoice on the ultimate recipient in T. Nagar. Only one e-way bill is needed for the movement, generated by either party with both invoice legs captured. How is interest calculated on a GST demand or late payment?

Which everyday goods now attract 5 percent GST?
The 5 percent slab now covers most household essentials that earlier fell in the 12 or 18 percent brackets: soaps, shampoos, toothpaste and toothbrushes, hair oil, bicycles, kitchen utensils and tableware. Packaged foods such as butter, ghee, cheese, namkeens, sauces, pasta, biscuits and chocolates are also at 5 percent, as are most medicines, medical devices and agricultural machinery.
