Ghanashyam Mishra & Sons (P) Ltd v. Edelweiss Asset Reconstruction Co Ltd — Supreme Court, (2021) 9 SCC 657, judgment dated 13-04-2021 · 2021-04-13

The Supreme Court laid down the "clean slate" principle. Once a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code, all claims not forming part of that plan stand extinguished. This expressly covers dues of the Central Government, State Governments and local authorities, including indirect tax dues. No creditor can afterwards initiate proceedings for a claim that was not lodged and dealt with in the plan.

Notification No. 20/2024-Central Tax · 2024-10-08

The CGST (Second Amendment) Rules, 2024 inserted Rule 164, effective 1 November 2024, prescribing Forms SPL-01 and SPL-02 for applying under the Section 128A scheme that waives interest and penalty on Section 73 demands of FY 2017-18 to 2019-20 once the tax is paid. The rules also inserted Rule 47A, requiring recipients liable under reverse charge to issue the self-invoice within thirty days of receiving supplies from unregistered persons.

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. The input tax credit you took at the old, higher rate remains fully intact in your credit ledger and is not restricted merely because output is now taxed lower; it simply sets off across your overall liability.
