This notification appointed Principal Chief Commissioners, Chief Commissioners, Principal Commissioners and Commissioners of Central Tax and specified the territorial jurisdiction of every Central Tax Commissionerate, Division and Range across India, including the Chennai zone. A trader erroneously filed nil GSTR-3B returns although its GSTR-2A and annual returns reflected eligible input tax credit, and the assessing officer rejected the ITC solely for non-claim in GSTR-3B. The Madras High Court held that where a registered person asserts eligible ITC, the officer must examine the claim on merits against the supporting documents, and cannot reject it purely because the credit was not reflected in GSTR-3B. The assessment orders were quashed and remanded.

CBIC Frequently Asked Questions on GST on pre-packaged and labelled goods, dated 17 July 2022 · 2022-07-17
A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
