It applied the relevant section note treating parts suitable for use solely or principally with a particular article as classifiable with that article. Tobacco products had been left at twenty-eight per cent in Schedule VII when GST 2.0 took effect, pending discharge of the compensation cess loan obligations. This notification omits Schedule VII entirely with effect from 1 February 2026 and moves pan masala, unmanufactured tobacco and refuse, cigars and cigarettes, other manufactured tobacco and nicotine inhalation products into Schedule III at forty per cent. Biris of tariff items 2403 19 21 and 2403 19 29 were placed in Schedule II at eighteen per cent.
What to do about it: Tobacco and pan masala wholesalers in Chennai charge forty per cent on supplies made on or after 1 February 2026, with biris at the lower eighteen per cent rate.
34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
What to do about it: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
