The 50th GST Council meeting decided that online gaming, casinos and horse racing would be taxed at 28 per cent on the full face value of bets or chips purchased, without distinguishing games of skill from games of chance. The Council recommended amending the GST laws to include online gaming and horse racing as taxable actionable claims. The decision reshaped the economics of the online real-money gaming industry and triggered large retrospective demand notices on gaming companies.
What to do about it: Any Chennai business operating or facilitating real-money games must register, charge 28 per cent on deposits and expect close departmental scrutiny of past periods.
LGW Industries Ltd v. Union of India — Calcutta High Court, 2021 · 2021-12-13
Buyers were denied ITC because their suppliers were later found non-existent and their registrations cancelled with retrospective effect. The Calcutta High Court remanded the matter, directing the authorities to verify whether the purchases were genuine, supported by valid invoices, made through banking channels, and effected before the cancellation; if the buyers acted in good faith after verifying the suppliers' registration on the portal, the benefit of input tax credit should not be denied to them.
What to do about it: Preserve portal verification screenshots, invoices, transport and bank records for every vendor — good-faith purchases made before a supplier's retrospective cancellation remain defensible.
CBIC Instruction No. 04/2025-GST · 2025-05-02
To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
What it means for you: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.
