Volvo-Eicher Commercial Vehicles Ltd — AAAR Karnataka, order dated 6 February 2020 (appeal from AAR Karnataka, Advance Ruling No. KAR ADRG 32/2019, dated 12 September 2019) · 2020-02-06
The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.
Why this matters: Where a foreign principal owns the warranty obligation and pays you for honouring it, the recovery can be defended as an export of service.
GSTN Advisory dated 8 May 2025 — changes in the refund filing process on the portal · 2025-05-08
GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
Practical effect: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.
Notification No. 13/2022-Central Tax · 2022-07-05
Acting under Section 168A, CBIC extended the time limit for issuing orders under Section 73 in respect of the financial year 2017-18 to 30 September 2023. It also directed that the period from 1 March 2020 to 28 February 2022 be excluded when computing the limitation for issuing a demand order for an erroneous refund, and when computing the two-year period for filing a refund application under Section 54 or Section 55. The exclusion applies automatically and does not require any application.
What to do about it: A Chennai exporter whose refund claim looks time-barred should recompute after excluding two full COVID years, as many apparently dead claims are in fact still alive.
