The Chennai company provided management consultancy and detailed project report services to the Chennai Metro Water Supply and Sewerage Board for water related projects. It asked whether the service attracted GST. The Authority held that the supply was a pure service with no supply of goods involved, rendered in relation to a function entrusted to a municipality, and was therefore exempt from GST under the entry covering pure services supplied to government and local authorities.

The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution. Only a discriminatory tax that favours local goods over goods from other States is hit. The judicially created concept of compensatory tax was discarded as having no constitutional basis. State entry tax laws were largely upheld, subject to the test of discrimination.

The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.
