Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

What it means for you: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Volvo-Eicher Commercial Vehicles Ltd — AAAR Karnataka, order dated 6 February 2020 (appeal from AAR Karnataka, Advance Ruling No. KAR ADRG 32/2019, dated 12 September 2019) · 2020-02-06

The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.

Deemed exports are notified domestic supplies treated like exports even though goods do not leave India, such as supplies to Export Oriented Units, supplies against Advance Authorisation, and supplies of capital goods against EPCG authorisation. What is the time limit for filing a GST refund application?
Form RFD-01 must be filed within two years from the relevant date defined in Section 54 of the CGST Act. For export of goods, the relevant date is the date the ship or aircraft leaves India; for export of services, it is the date of receipt of foreign exchange or the invoice date, whichever is later; for inverted duty structure, it is the due date of the return for the period in which the claim arises. Missing the two-year window makes the refund time-barred, so track pending claims carefully and file early.
I export goods after paying IGST. How do I get that tax back?
For export of goods with payment of IGST, no separate RFD-01 is needed. The shipping bill filed with customs is itself treated as the refund application once you file GSTR-1 with correct shipping bill details in Table 6A and pay the tax through GSTR-3B. Customs matches the data from the GST portal with ICEGATE and credits the refund directly to your bank account. Most delays happen because of invoice mismatches between GSTR-1 and the shipping bill, or bank account validation errors, so reconcile both before filing each month.
What documents do I need to attach with a GST refund application?
The documents depend on the refund category. Export refunds under LUT need a statement of invoices with corresponding shipping bill numbers and dates, or FIRC and BRC for service exports. Inverted duty claims need statements of inward and outward supplies with the Rule 89(5) computation. Yes. Before rejection, the officer must issue a notice in RFD-08 and consider your reply in RFD-09, so a rejection without hearing you is itself challengeable. Against a rejection order in RFD-06, you can file an appeal in Form APL-01 before the appellate authority within three months of the order. The ITC debited for the rejected claim is re-credited through PMT-03 where applicable. A deficiency memo in RFD-03 means the officer found your application incomplete, and the application is treated as not filed. You cannot reply to an RFD-03; you must file a fresh RFD-01 after curing the defects, and the debited ITC or cash is re-credited to your ledger. Importantly, the fresh application must still fall within the original two-year limitation, so act quickly. Read the memo carefully, fix every listed deficiency, and refile with a covering note. There is no outer time limit on issuing a debit note itself.
