An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

Most items carry central tax of 2.5 per cent, that is five per cent combined: handcrafted candles, carved and inlaid wood products, wooden frames, art ware of cork and sholapith, vegetable-fibre mats and basketwork, handmade paper, papier mache articles, coir goods, handmade carpets, stone carving, ceramic and glass art ware, brass and copper art ware, wooden toys, hand paintings and original sculptures. Silver filigree work and handmade imitation jewellery, including jewellery of natural seeds and beads, carry 1.5 per cent central tax, that is three per cent combined.

The recipient's location and registration are irrelevant.
