Council clears entire pending GST compensation dues to states

49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18

The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.

ITC and credit note deadline moved to 30 November of the next year

Notification No. 18/2022-Central Tax · 2022-09-28

This notification brought most of the Finance Act, 2022 amendments into force from 1 October 2022. Section 16(4) was amended so that input tax credit for a financial year can be claimed up to 30 November of the following year instead of the due date of the September return. The same deadline now applies to issuing credit notes under Section 34 and to rectifying errors in GSTR-1 and GSTR-3B. Section 41 was also substituted to remove provisional credit and sequential filing of returns was mandated.

What to do about it: A Chennai business gets until 30 November to pick up missed credit and to issue credit notes for the previous year, which is the single most important annual deadline after the returns themselves.

Circular No. 179/11/2022-GST · 2022-08-03

The Board settled several goods classification disputes following the 47th GST Council meeting. It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Rates on fly ash bricks and blocks and on certain by-products of milling of pulses were also clarified.

Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. My landlord in Uthandi has no GSTIN but my business is registered. Who pays GST on the shop rent?
You do. With effect from 10 October 2024, renting of immovable property other than a residential dwelling by an unregistered person to a registered person was brought under reverse charge through Notification 09/2024-Central Tax (Rate). So a registered trader renting a shop from an unregistered landlord must pay 18 percent under RCM through GSTR-3B and can claim it back as input tax credit if eligible. My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. This timing point is routinely missed by businesses in Uthandi handling bulk orders.

How do I file a nil GSTR-3B by SMS?
From the mobile number registered as authorised signatory, send an SMS to 14409 in the format NIL space 3B space your GSTIN space tax period in MMYYYY format. The portal replies with a six-digit verification code; confirm by sending CNF space 3B space the code to 14409. You receive an ARN on successful filing. SMS filing works only if the return is genuinely nil, meaning no outward supplies, no liability of any kind, and no pending returns for earlier periods. If the SMS route fails, we can file it online for you the same day.
How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Uthandi architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise. A hardware store in Uthandi can bill cement at 18 percent and certain tools at 5 percent on one document. What matters is that each line is classified and taxed correctly, and that mixed baskets are not collapsed into one rate. Be careful with genuine composite supplies, where one principal supply drives a single rate; that is a classification question, not an invoicing one.

Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Uthandi on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
Can my GST registration be cancelled for not filing returns?
