Notification No. 11/2025-Central Tax · 2025-03-27

CBIC amended Rule 164 to resolve a practical roadblock in the Section 128A scheme. Where a single notice or order spans FY 2017-18 to 2019-20 as well as periods outside the scheme, the taxpayer may pay the tax attributable only to the covered period and need not withdraw the whole appeal, a new proviso permitting partial withdrawal limited to the covered period while the appeal continues for the balance. The amendment also confirms that no refund arises for tax, interest or penalty already discharged for the entire period.

What to do about it: A demand order mixing amnesty-eligible and other years no longer forces an all-or-nothing choice; the waiver can be taken for 2017-20 while litigating the rest.

Bharat Sanchar Nigam Ltd v. Union of India — Supreme Court, (2006) 3 SCC 1, judgment dated 02-03-2006 · 2006-03-02

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Velachery as urgent.
