CBIC laid down the prerequisites for an intermediary. The supplier must have the character of a broker or agent playing a supportive role, and a person supplying goods or services on his own account on a principal-to-principal basis is not an intermediary. Sub-contracting is expressly excluded, and illustrations are given for software support and marketing services.
