CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises. However, no refund is available to anyone who paid at the higher rate or did not claim the exemption, and the circular works through illustrations showing exactly which past positions stand closed.
Practical effect: Read any rate clarification circular alongside its regularisation paragraph, because that paragraph often extinguishes the entire exposure for earlier years.
Notification No. 38/2021-Central Tax · 2021-12-21
The Aadhaar authentication requirements inserted earlier by the Eighth Amendment Rules had been left to take effect from a date to be notified. This notification appointed 1 January 2022 as that date, so that from the beginning of 2022 a refund application, a revocation application and an integrated tax refund on exports all became conditional on completed Aadhaar authentication and on a PAN-linked bank account. Applications filed without these steps are simply not processed on the portal.
Practical effect: From January 2022 onwards Aadhaar authentication is a gating requirement, so it should be completed at the registration stage rather than when a refund is urgently needed.
44th GST Council Meeting (video conferencing) — 12 June 2021 · 2021-06-12
Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.
Practical effect: These were temporary rates with a hard expiry, so suppliers must be able to show that concessional invoices fall inside the notified relief period.
