Circular No. 203/15/2023-GST · 2023-10-27

CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.

Health care services are defined as diagnosis, treatment or care for illness, injury, deformity, abnormality or pregnancy in any recognised system of medicine, and expressly exclude cosmetic or plastic surgery unless done to restore or reconstruct anatomy affected by injury or congenital defect. Hair transplant and purely cosmetic procedures are therefore taxable.

What to do about it: A Chennai hospital or clinic is exempt on treatment, but must charge GST on cosmetic procedures, pharmacy sales to outsiders and rental of space to shops.

The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in West Mambalam as urgent.

For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt.
