Consignments were detained because the e-way bills accompanying them had expired. The Court directed immediate release on furnishing a bank guarantee and, importantly, directed the assessing officer to consider whether the lapse was a substantive violation or only a technical breach, having regard to Sections 122, 125 and 126 of the CGST Act. Adjudication was to be completed within four weeks, with amounts already remitted by the transporter adjusted against the final determination.

Following the principal-agent circular, CBIC clarified the position of a del credere agent who guarantees payment by the buyer. Whether he is an agent under Schedule I again depends on whether he invoices the goods in his own name. Where he is not an agent and extends short-term credit to the buyer, the interest he charges is exempt as a supply of extending deposits or loans; where he is an agent, the interest forms part of the value of the supply of goods.
What to do about it: Agents who finance their buyers should document whether they invoice the goods themselves, since that determines whether the interest they collect is exempt or taxable.

The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. Placing the cess ceilings in the statute meant that later cess increases, such as the one on cigarettes a few months afterwards, could be made by notification without returning to Parliament.
Practical effect: Tamil Nadu's own SGST Act follows the template approved here, which is why the State and Central provisions a Chennai business faces are near-identical.
