As in the first wave, the five per cent restriction on credit for invoices not uploaded by suppliers was not applied separately to April and May 2021. The condition was to be applied cumulatively for those two periods and the cumulative adjustment made in the GSTR-3B for May 2021. The same notification extended the window for using the invoice furnishing facility for April 2021 to twenty-eight days from the end of the month, so that recipients were not deprived of credit.
Practical effect: Month-wise ITC mismatch computations for April and May 2021 are legally incorrect, and this notification is the answer to a scrutiny notice covering those months.
Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.

With the revised model law still to be brought back to the Council, the fitment of rates incomplete and taxpayers needing time to configure their accounting systems, the Council unanimously agreed to extend the GST rollout date to 1 July 2017. Maharashtra, Assam and Bihar had pressed for 1 April 2017, Assam adding that changing the tax regime in the middle of a financial year was undesirable, but the Chairperson observed that the legal and rate work would spill into March 2017 and that an April deadline had become a major challenge. Tamil Nadu and Karnataka supported 1 July 2017 as the more practical date.
Why this matters: GST law in India runs from 1 July 2017, so the first return periods, the first annual return and all transitional credit deadlines are measured from that date.
