Circular No. 136/06/2020-GST dated 3 April 2020 · 2020-04-03

CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

The first notification of 1 May 2021 set the outer date at 31 May 2021 and the second of 1 June 2021 moved it to 30 June 2021. The relief covered completion of proceedings, passing of orders, issue of notices, filing of appeals, replies and applications, but excluded return filing and tax payment which were dealt with separately.

The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?

If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I agree with part of the ASMT-10 discrepancy but not all of it. How do I respond?
A split response is perfectly acceptable and often the wisest course. Pay the portion you accept through Form DRC-03 with interest at 18 percent per annum, and in your ASMT-11 reply state the payment details along with a reasoned explanation for the balance, supported by reconciliations, invoices and ledger extracts. Paying the admitted amount voluntarily at the scrutiny stage avoids penalty on it under Section 73 and shows bona fides, which helps the officer accept your explanation on the disputed part. What is the difference between GST return scrutiny and a departmental audit?
