CBIC explained the implementation of the retrospective ITC relaxations: for FY 2017-18 to 2020-21, credit claimed in GSTR-3B filed up to 30 November 2021 is valid, and taxpayers with confirmed demands on this sole ground must use the special rectification procedure rather than appeals where the order was not contested. It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.
Why this matters: The 16(4) relief works only prospectively against pending or unpaid demands; amounts already paid or reversed cannot be recovered as refunds, so prioritise open cases.

A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.
What to do about it: Plot developers should read the 2022 CBIC clarification alongside older adverse rulings before conceding GST on plot sales or on development charges.
Kompress India (P) Ltd v. Union of India — Madras High Court (Madurai Bench), W.P.(MD) No. 17461 of 2023, decided 1 August 2023 (S. Srimathy J.) · 2023-08-01
The goods travelled with a proper invoice and a valid e-way bill, yet were detained and penalised under Section 129. The Court quashed the order, holding that Section 129 proceedings cannot be launched when the prescribed documents are in fact produced, and that issuing the notice, conducting the inspection and passing the order all on one day denies the seven-day period to reply and violates natural justice. It also rejected the contention that the buyer needed GST registration, since liability rests on the supplier.
What to do about it: Chennai businesses should note the timestamps on detention paperwork — a same-day notice and order is itself a ground to have the Section 129 penalty set aside.
