This was the first notification issued under the CGST Act. It appointed 22 June 2017 as the date on which the preliminary and registration provisions came into force, including sections 1 to 5, section 10 (composition levy) and sections 22 to 30, which deal with who must register, compulsory registration, the procedure for registration, amendment of registration and cancellation. It opened the GST registration window before the tax itself became payable.

Circular No. 224/18/2024-GST · 2024-07-11

Because the GST Appellate Tribunal was not yet operational, CBIC directed that taxpayers who lost their first appeal could pay the additional pre-deposit required for a Tribunal appeal through the electronic liability register and file an undertaking to appeal once the Tribunal starts functioning. On doing so, recovery of the balance confirmed demand stands stayed under Section 112(9). Officers were told not to coerce full payment merely because the appellate forum was unavailable.

Why this matters: After an unfavourable first-appeal order, paying the ten per cent Tribunal pre-deposit with an undertaking legally halts recovery until GSTAT hears the case.

If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. An equal penalty applies under the SGST Act.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
How will I know my scrutiny reply has been accepted by the GST officer?
If your explanation in ASMT-11 is found acceptable, the officer issues Form ASMT-12 informing you that the discrepancies stand explained and no further action is required on those points. The order appears in your Additional Notices and Orders tab on the portal. Keep the ASMT-12 safely with your reconciliation working papers, because the same period can still come up in a later audit and the closure order is your best shield. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Adyar architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Distributor incentive schemes run from Adyar should be papered before the season starts, not after.
Which food items became completely tax-free under GST 2.0?
